In response to the show cause notice issued vide order dated November 25, 2005, an affidavit has been filed by Surinder Kaur Kataria, District Education Officer (SE), Bhatinda respondent No.3.
Though, in the affidavit it is averred that upon re-fixation of the petitioner's pay as per the directions issued by this court, arrears amounting to Rs.89,270/- have been paid to him vide receipt dated 22nd June, 2006,
however, it is not disputed that the aforesaid arrears pertain to a period of 38 months immediate prior to the filing of the writ petition by the petitioner.
While allowing the petitioner's writ petition vide order dated March 4, 2003, this Court did not restrict the payment of arrears of pay for a period of 38 months, rather, it was categorically directed that after working out the arrears, the same be paid to him within six weeks.
COCP No.1398 of 2005 -: 2 :-
Accordingly, this petition is disposed of with a direction to the respondents to pay the balance arrears of pay to the petitioner within two months from today failing which the petitioner shall be at liberty to get these proceedings revived.
