Mehar Singh and his son Mangat Ram alias Bagha have filed this petition under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 125 dated 19.8.2006 under Sections 323, 324, 325, 326/34 IPC, registered at Police Station Rajound, Tehsil and District Kaithal.
I have heard counsel for the parties and gone through the contents of the FIR as well as the order dated 29.9.2006, passed by Additional Sessions Judge, Kaithal, whereby bail to the petitioners has been declined.
As per the allegations in the FIR, petitioner No.1 caused grievous injury on the ear of the complainant. The petitioners are in custody since 27.8.2006. Counsel for the petitioners contends that trial is not likely to conclude soon, as even charge has not been framed so far.
In view of the aforesaid facts, which have not been disputed by the State Court, I deem it appropriate to grant regular bail to the petitioners.
They are accordingly ordered to be released on bail subject to their furnishing bail bonds to the satisfaction of the trial court.
