Filing of this FAO is barred by an inordinate delay of 2293 days.
We have carefully examined the explanation given for the delay. We do not find any sufficient cause to condone the inordinate delay.
Further, in terms of a judgment of Hon'ble the Apex Court reported in AIR 1998 SC 2276 (P.K.Ramachandran versus State of Kerala and another), we cannot extend the limitation on equitable ground. That apart, it appears that the appellants had made an application for correction of error before the Tribunal, which was rejected and, thereafter, they had come in revision, which was dismissed on merits. Thereafter, the appellants have chosen to challenge the award, with an inordinate delay. It appears that both the appellants have now turned major and they have filed the appeal in the death case of their mother. Since the appellants have their own source of income and filing of the appeal is hopelessly barred by inordinate delay, this appeal is dismissed on the ground of delay as well as on merits in limine.
