This is a petition under Section 482 of the Code of Criminal Procedure for quashing of FIR bearing No. 49 dated 17.7.1997, under Sections 324, 323, 427, 148, 149 IPC, Police Station Bholath, District Kapurthala.
It is contended that cases have been traded between the two sides. While respondent no.2 Raj Rani lodged the present FIR, a criminal complaint has been filed by Ramesh Kumar, petitioner no.1 against Krishan Lal and others. On the intervention of the respectable, both the parties have arrived at a compromise and both the cases are required to be withdrawn under the terms of compromise.
Affidavit dated 20/21.11.2006 has been filed on behalf of the respondent no.2. Learned counsel Deepak Sabharwal represents respondent no.2. Even respondent no.2 is present in court in person. It is stated that respondent is not ready to pursue the FIR case in view of the compromise and would have no objection if the FIR and proceedings are quashed.
Learned counsel appearing for the respondent / State on instructions from ASI Shiv Singh states that untraced report has been filed as far back as on 20.8.97.
Considering the facts and circumstances of the case,FIR bearing No. 49 dated 17.7.1997, under Sections 324, 323, 427, 148, 149 IPC, Police Station Bholath, District Kapurthala is hereby quashed.
Petition is allowed.
