This is a petition under Section 439 of the Code of Criminal Procedure for bail in a case lodged under Sections 307, 336, 341, 323, 34 IPC read-with Section 25, 27 of the Arms Act.
It is pleaded that although the petitioner Santokh Singh @ Sukha has been attributed grievous injury on the person of Beant Singh and Lakhwinder Singh with Kirpan,however, injured has been discharged from the hospital and has not suffered any permanent physical disability. Petitioner is in custody since 29.4.2006. Challan has already been presented and therefore, there is no chance of the petitioner interfering with the investigation.
Learned counsel appearing for the respondent / State while opposing the bail has not disputed the facts stated above. The argument raised is that the injuries were found dangerous to life.
Considering the custody period as also the fact that the injured have been discharged from the hospital and have not suffered any permanent physical disability and other facts and circumstances of the case, this petition is allowed.
Bail to the satisfaction of Chief Judicial Magistrate / Duty Magistrate, Patiala.
