Petitioner Jaswinder Singh, apprehending his arrest in a non- bailable offence in case FIR No. 138 dated 14.9.2006 registered at Police Station Bassi Pathana, under Section 304-B IPC, has filed this petition under Section 438 of the Code of Criminal Procedure for the grant of anticipatory bail.

I have heard counsel for the parties and have gone through the contents of the FIR as well as the order dated 26.9.2006, passed by Sessions Judge, Fatehgarh Sahib, whereby bail application of the petitioner has been dismissed.

Counsel for the petitioner contends that the petitioner is in no way related either to the deceased or the family of her husband. He has been implicated in this case falsely only on the ground that he is co-villager.

Counsel contends that as far as petitioner is concerned, it cannot be said that he was harassing the deceased on account of demand of dowry.

Counsel for the petitioner further states that in terms of the interim order dated September 29, 2006, the petitioner has joined the investigation. The State counsel does not dispute this fact and he further states that during investigation, the petitioner has been found innocent by the DSP.

In view of the above, without commenting on the merits, the interim bail, granted vide order dated September 29, 2006, is made absolute subject to the same terms and conditions.

Disposed of accordingly.
