Ishwar Singh petitioner has filed this habeas corpus petition alleging therein that the persons named in para 2 of the petition have been illegally detained by respondents No.5 to 8 at their brick kiln.
On November 13, 2006, notice of motion was issued to A.G., Punjab, as well as the private respondents.
Today, reply on behalf of respondents No.1 to 4 has been filed in Court today. The same is taken on record. Counsel for the respondents have pointed out that earlier, one Rajesh had filed a similar petition i.e. Crl.
W.P. No. 959 of 2006, in which Warrant Officer was appointed, who vide his report dated 28.10.2006 reported that the alleged detenues were found present in their hutments and their kids were playing in the adjoining fields along with others and none of the alleged detenues was found in illegal detention and that they were moving freely. In view of the aforesaid report, the petition was dismissed by this Court on 30.10.2006. A perusal of the earlier petition reveals that names of the alleged detenues is the same as is mentioned in this petition.
In view of the aforesaid factual position, this petition is dismissed.
