Submits that the petitioner corporation is the respondent in the learned Labour Court and the evidence of the petitioner has been closed by the learned Presiding Officer, Amritsar, on 1.8.2006 by order. Further submits that the case is now fixed for 27.11.2006 before the learned Labour Court and if one opportunity is granted to the petitioners on payment of cost they will produce the evidence at their own responsibility and would close the same.
If notice is granted to the respondent it will delay the disposal of the petition and will also delay the disposal of the reference pending before the learned Presiding Officer, Labour Court, Amritsar, since the year 2000.
In the interest of justice, the petitioners should be granted an opportunity to produce the evidence on their responsibility and close the same. The other side can be compensated by payment of cost.
Therefore, this petition is accepted on payment of cost of Rs.
3,000/-. The costs shall be tendered by the petitioners before the learned Presiding Officer Labour Court, Amritsar on 27.11.2006 for onward payment to the respondent. On that date the learned Presiding Officer shall grant one opportunity of about two weeks' time to the petitioners for producing the evidence at their own responsibility and closing the same. If the petitioners fails to make the payment of costs or fail to produce the evidence at their own responsibility and close the same, as stipulated above, then they would not be entitled to any other opportunity.
