This is petition for grant of regular bail. Case is for the offence under Sections 420/406 IPC.
On behalf of the petitioner, it is argued that the case is triable by the Magistrate and that now the petitioner is in custody since 5.8.2006.
Application is opposed on behalf of respondent-State pleading that the petitioner had jumped bail and remained absent continuously for a period of two years. It is stated that the next date fixed before the trial Court is 8.12.2006.
After hearing counsel for the parties, it is directed that the trial CRL.M.No.70124-M of 2006 #2#
Magistrate shall hold day to day trial in this case and shall make all out efforts to complete the trial as expeditiously as possible. If the trial is not completed within a period of three months from the next date fixed by the trial Court for no fault of the petitioner then he shall be released on bail by the trial Court to its satisfaction.
