Petitioner Kamlesh Rani (complainant) has filed this petition under Section 482 of the Code of Criminal Procedure for issuing direction to the trial court to expedite the trial in case FIR No. 120 dated 22.3.2002 under Sections 420, 467, 468, 471, 120-B IPC, registered at Police Station Division No.5, Ludhiana, pending in the Court of Additional Chief Judicial Magistrate, Ludhiana.

I have heard counsel for the petitioner.

In the petition, it has been stated that the aforesaid FIR was registered on the directions issued by this Court in Crl. Misc. No. 22696-M of 2000. Thereafter, when the police did not complete the investigation, the petitioner again filed Crl. Misc. No. 63361-M of 2005 for directing the investigating agency to complete the investigation and submit the final report. The said petition was disposed of on 21.11.2005, by issuing direction to the investigating agency to submit final report within a period of three months. Thereafter, the challan was presented on 30.11.2005.

Counsel for the petitioner contends that after the expiry of one year, charge has not been framed by the trial court and the trial is being delayed.

After hearing counsel for the petitioner, in view of the aforesaid facts, this petition is disposed of with a direction to the trial court to expedite the trial in the aforesaid FIR and try to complete the same within a period of one year.
