During arguments, it transpires that in consequent to the order dated 21.11.2005, which is under challenge, in this writ petition, the matter was heard afresh and application of the petitioner was dismissed on 1.6.2006. Confronted with this situation, counsel for the petitioner states that he be allowed to withdraw this writ petition with liberty to lay challenge to the order, referred to above, as per law, if permissible.

Liberty granted.

Dismissed as withdrawn.
