Petitioner Paramjit Kaur @ Guddi apprehending her arrest in a non- bailable offence in case FIR No.126 dated 27.7.2006 registered under Sections 406/420 IPC at Police Station Samrala, District Ludhiana, has filed this petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail.
Counsel for the petitioner contends that the petitioner, who is a lady, has been falsely implicated in the aforesaid case because she is a relative of the main accused. The main accused in this case, in whose account the payment was made, is Parminder Singh, non-applicant. Counsel further contends that in terms of the interim order dated August 31, 2006, the petitioner has joined the investigation. The factum of joining the investigation by the petitioner has not been disputed by the State counsel.
In view of the above, the interim order dated August 31, 2006 is made absolute on the same terms and conditions.
This bail order shall remain in operation till the investigation culminates into filing of challan under Section 173 Cr.P.C. Thereafter except for material change in the circumstances, the petitioner shall be entitled for the grant of regular bail by the trial Court on the terms and conditions to be imposed by the court.
Disposed of accordingly.
