This appeal has been filed against the judgment and decree dated 18.9.2006 passed by District Judge, Kaithal, vide which application filed by the appellant as also the respondent, under Section 13-B of Hindu Marriage Act, 1955, (for short, "the Act"), was dismissed.
It is apparent from the records that after filing of his affidavit, when the husband was examined in Court, he specifically stated that he had filed the affidavit under the pressure of his parents. His father, who was present in Court, has also admitted this fact. Thereafter, the husband had not turned up for recording his second statement, which is envisaged under Section 13-B of the Act. The Court below dismissed the application for F.A.O. No. 273-M of 2006 2
divorce, by relying on the ratio of a Division Bench judgment of this Court in Harcharan Kaur v Nachhattar Singh, AIR 1999 (P&H) 27.
We feel that the judgment passed by the court below is justified and is fully covered by the judgment, referred to above.
No case is made out for interference.
