Sukhdev Singh v. State of Punjab and Ors - CRA-S-57154-M-2006 RD-P&H 10967 (21 November 2006)
CRL.M.No.57154-M of 2006
DATE OF ORDER:29.11.2006
State of Punjab and Others
CORUM : HON'BLE MR. JUSTICE M.M. AGGARWAL .*.*.*.
Present: Mr. A.S. Trikha, Advocate.
Mr. G.S. Bhandari, DAG, Punjab.
Petitioner, who is confined in Central Jail, Ferozepur, had applied for parole for house repair. His request was declined on the report of DM/SSP that the petitioner is a smuggler and that if comes out on parole he can be indulged in smuggling and therefore petitioner should not be released on parole.
Petitioner is stated to be in custody for the last five years and was convicted two years back and is stated to have not availed of any parole.
I find it a fit case, where some parole should be given. If there CRL.M.No.57154-M of 2006 #2#
is any apprehension then heavy surety can be demanded.
Two weeks' parole is granted to the petitioner on filing bonds to the satisfaction of the District Magistrate concerned.
Petition stands disposed of.
