The petitioners, who are husband, father-in-law and mother-in- law of the complainant-respondent No.2, have filed this petition under Section 482 of the Code of Criminal Procedure for quashing of FIR No. 31 dated 4.4.2001 under Sections 498-A, 406, 323, 506 IPC, registered at Police Station Kalka.
I have heard counsel for the petitioners.
In the aforesaid FIR, the petitioners have been convicted by the trial court and their appeal against the same is pending before the appellate court. It is case of the petitioners that during the pendency of appeal, the parties have compromised the matter. Keeping in view the fact that appeal against the conviction of the petitioners is pending, I am not inclined to entertain this petition.
However, it will be open for the petitioners to argue the case before the appellate court on the basis of the alleged compromise.
