Ramesh Mohan Khullar v. State of Punjab & Anr - CWP-18476-2006 [2006] RD-P&H 11033 (21 November 2006)

CWP NO.18476 of 2006 1

IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CWP NO.18476 of 2006

DATE OF DECISION: 23.11.2006

Ramesh Mohan Khullar ....Petitioner

Versus

State of Punjab and another ....Respondents.

CORAM: HON'BLE MR.JUSTICE J.S. KHEHAR
HON'BLE MR. JUSTICE S.D. ANAND

PRESENT: Ms. Meenal Goyal, Advocate for

for the petitioner.

J.S. Khehar, J. (oral)

Through the instant writ petition, the petitioner seeks a direction to the respondents to consider her name for promotion to the post of Establishment Officer or Budget Accounts & Audit Fee Recovery Officer in the office of the Chief Auditor, Cooperative Societies, Punjab.

It is also the contention of the learned counsel for the petitioner, that the petitioner addressed two representations dated 27.3.2006 and 1.9.2006 (Annexures P-9 and P-10 respectively) to the authorities, requiring them to take a final decision thereon. It is, however, pointed out that no decision has been taken thereon by the respondents till date.

Learned counsel for the petitioner states that the petitioner will be satisfied if the instant writ petition is disposed of with a direction to respondent No.1 i.e. the Secretary, Department of Cooperation, Punjab, CWP NO.18476 of 2006 2

requiring him to take a final decision on the representation dated 1.9.2006 (Annexure P-10).

Notice of motion.

On our asking, Mr. Ashok Aggarwal, Additional Advocate General, Punjab, accepts notice on behalf of respondents No.1 and 2.

Learned counsel for the respondents states that he has no objection to the disposal of the instant writ petition in terms of the prayer made by the learned counsel for the petitioner.

In view of the above, without going into the merits of the claim raised by the petitioner, we consider it just and appropriate to dispose of the instant writ petition by directing respondent No.1 i.e. the Secretary, Department of Cooperation, Punjab, to take a final decision on the representation dated 1.9.2006 (Annexure P-10), by passing a well reasoned speaking order within one month from the date of receipt of a certified copy of this order.

Disposed of accordingly.

Order dasti, on payment of usual charges.
