Through the instant writ petition, the petitioner is impugning the order dated 6.10.2006 passed by the office of the Director, Education Department (Colleges), Punjab, whereby the petitioner has been required to be reverted from the post of Lascar to the post of Sewadar. A perusal of the impugned order reveals that there is no avenue of promotion from the pot of Sewadar to the post of Lascar. It also reveals that the petitioner was required to discharge the duties of the post of Lascar temporarily.
During the course of hearing, learned counsel for the petitioner acknowledged that the post of Lascar is not a sanctioned post in the Education Department, of which he is an employee.
In view of the factual position, noticed hereinabove, we find no justification in the claim of the petitioner. Even though learned counsel for the petitioner vehemently contends, that the petitioner has CWP NO. 18667 of 2006 2
been discharging the duties of the post of Lascar for a period of 26 years.
it is not possible for us to affix the judicial stamp of approval on his appointment against the post of Lascar, which was obviously extraneous and not supported by any statutory rule.
