The impugned order was passed by the Labour Court on 21.3.2003. In terms of the said order the defence of the management was disallowed as written statement had not been filed despite last opportunity.
Even costs of Rs.600/- that had been imposed were not paid by the management despite specific demand.
The present revision petition against the aforesaid order dated 21.3.2003 has been filed on 31.10.2006 i.e. after a lapse of more than three years. Learned Deputy Advocate General, Haryana appearing for the petitioners had taken time to ascertain whether reference before the Labour Court is still pending or has been decided. It is submitted that the reference is still pending and the management be granted an opportunity to file written statement.
Keeping in view the fact that this petition has been filed after a period of three years and even the costs have not been paid, no ground for interference with the impugned order is made out in exercise of jurisdiction under Article 227 of the Constitution of India.
The revision petition is accordingly dismissed.
