The petitioner filed C.W.P.No.7482 of 2005 seeking a direction for his appointment to the post of J.B.T. Teacher. The writ petition was disposed of vide order dated September 16, 2005 with a direction to the respondents to consider his claim for appointment in the light of various judgments passed by this Court, a reference to which was made in the above-stated order.
Alleging non-compliance of the above-stated order, this contempt petition has been filed.
In response to the show cause notice issued to respondents No.1 and 2, an affidavit has been filed by Mr.Anand Sharma, Director, Elementary Education Haryana. Along with the said affidavit, he has appended an order dated 8.2.2006 (Annexure R-1) vide which the petitioner's claim has been considered.
A perusal of the order reveals that the petitioner is at merit No.39 whereas candidates upto Sr.No.20 only have been given appointment. According to the respondents, there is no vacant post available against which the petitioner and/or the candidates higher to him in merit and yet to be offered appointment, can be appointed.
In this view of the matter, the directions issued by this Court stand complied with. Accordingly, the petition is disposed of with liberty to the petitioner to impugn the above-stated speaking order dated 8.2.2006 before an appropriate forum, if so advised.
