This is a petition under Section 482 of the Code of Criminal Procedure for issuance of directions to respondents 1 to 3 to hand- over the investigation of FIR bearing No. 93 dated 27.5.2006, under Sections 307, 148, 149IPC and Sections 25 and 27 of the Arms Act, Police Station Jaito, District Faridkot to Crime Branch, Punjab, Chandigarh. It is pleaded therein that the petitioner no.1 lodged FIR against the respondents 5 to 9 on 27.5.2006, however, no action is being taken.
Learned counsel appearing for the respondent / State on the basis of pleadings in reply / para 3 states that investigation was conducted by Deputy Superintendent of Police Kotkapura as also by Mr. Lal Singh, Deputy Superintendent of Police, Faridkot. In both enquiries, commission of cognizable offence has not been found and therefore, cancellation report has been prepared which shall be presented in Court having competent jurisdiction.
Considering the stand of the respondent, the petition is disposed of with the observation that the petitioner no.1 complainant shall have the right to file a protest petition to the cancellation report which shall be dealt with in accordance with law.
