This is a petition under Section 482 of the Code of Criminal Procedure for quashing of FIR bearing No. 19 dated 6.2.2003, Police Station Beas, registered under Section 354 IPC.
It is pleaded that during the proceedings, the parties have entered into a compromise which has been formalized vide a deed dated 6.10.2006 and has been placed on record as Annexure P3. It is pleaded that the respondent no.2 complainant and the petitioner belong to the same family, living in the same village and are neighbors. Section 354 IPC is compoundable under Section 320(2) Cr. P. C with the permission of the Court.
Notice of motion was issued. Respondent no.2 has filed affidavit. The factum of compromise has been endorsed in the affidavit dated 5.12.2006 which is taken on record.
Considering the facts and circumstances of the case and the fact that the respondent no.2 is accompanied by her lawyer Mr. Avtar Singh, this petition is allowed. Compounding of offence is allowed.
Accordingly,FIR bearing No. 19 dated 6.2.2003, Police Station Beas, registered under Section 354 IPC is hereby quashed.
