Petitioner Harbans Lal Gupta has filed this petition under Section 482 Cr.P.C. for issuing direction to the respondents to register a criminal case against the bank officials on the basis of report dated 17.8.2006, Annexure P-2.
I have heard counsel for the petitioner and gone through the contents of the petition as well as the complaint, Annexure P-1 and the report Annexure P-2.
In this case, the alleged mis-appropriation and illegalities were committed 17 years back. Keeping in view the facts and circumstances of the case, I do not find the instant case as an exceptional case, where this Court should exercise its inherent powers under Section 482 Cr.P.C. for issuing direction to register a criminal case, as in my opinion, the petitioner has alternative remedy, as has been held by this Court in Mithlesh Kumari v. State of Punjab, 2002 (4) RCR (Criminal) 541 and by the Hon'ble Supreme Court in Gangadhar Janardan Mhatre v. State of Maharashtra and others, (2004) 7 SCC 768 and Minu Kumari and another v. State of Bihar and others, (2006) 4 Supreme Court Cases 359.
Dismissed.
