The petitioner has filed this petition under Section 439 Cr.P.C.
for the grant of regular bail in case FIR No. 5 dated 15.1.2000 under Sections 452/323/427/342/506/379/148/149 IPC, registered at Police Station Islamabad, Amritsar.
I have heard counsel for the parties and gone through the contents of the FIR.
The petitioner has been named as one of the accused in the aforesaid FIR. The said FIR was registered against 60-70 persons, out of which challan was filed only against six accused. Out of six accused, two persons including the petitioner, was declared proclaimed offender in August 2001. The other four accused have been acquitted on the ground that there is no evidence against them. The petitioner has been arrested on 19.9.2006 and since then he is in custody. The supplementary challan has already been filed against the petitioner.
Keeping in view the aforesaid facts, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of trial Court.
