The claim made by the petitioner in the instant petition is for issuance of direction to the respondent to consider his case for promotion to the post of Sub Divisional Officer (Panchayati Raj) with effect from the date from which the person immediate junior to him (Sh.Puran Singh) was promoted with all consequential benefits. In that regard, the petitioner has already sent a legal notice to the respondent through his counsel on 9.1.2006 (Annexure P4) which is stated to be still pending consideration of the respondent. Learned counsel for the petitioner states that the petitioner would be satisfied if a time bound direction is issued to the respondent to decide his legal notice in accordance with Rules, Instructions and relevant case law.

Learned State counsel has not raised any objection if the C.W.P.No.4867 of 2006 2

aforementioned course is adopted for the disposal of the instant petition.

In view of the above we disposed of the writ petition by directing the respondent to take cognizance of the legal notice dated 9.1.2006 (Annexure P7) sent by the petitioner through his counsel ;and take final decision on the same expeditiously by passing a speaking order.

The needful shall be done within a period of two months from the date a certified copy of the order is received by the respondent.

The writ petition stands disposed of in above terms.
