This petition filed under Articles 226 & 227 of the Constitution prays for issuance of a writ in the nature of mandamus directing the respondents to refix the pay of the petitioner after giving benefits of second ACP as he has completed 20 years of service in the respondent department and he is also entitled to first ACP on the pay scale of Rs.2000-60-2300-EB-75-320 and not on the pay scale of Rs.1640-60-2000-EB-75-2900 since 1.1.1996.

For the relief claimed in the instant petition, the petitioner has already sent a legal notice, dated 5.10.2006 (Annexure P4) to the respondents.
Without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the legal notice, dated 5.10.2006 (Annexure P4) sent by the petitioner and decide the same expeditiously preferably within a period of four months from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed.
Petition stands disposed of in the above terms.
