The instant petition is directed for issuance of a Writ in the nature of Certiorari quashing the order No.3/65-2006-O&M(2) dated 9.10.2006 (Annexure P4) vide which the petitioner was transferred from Government Senior Secondary School, Sahuwala-II, District Sirsa to Government Senior Secondary School Punahana, District Mewat, which is 300 Kms. away from District Sirs, in mid of the Session, in violation of transfer policy ignoring the fact that the petitioner has shown 100% results during his two years' stay in the aforementioned School and ignoring the fact that the petitioner was appointed in District Sirsa on C.W.P.No.18557 of 2006 2

16.12.2004 in pursuance to the recommendations made by the Haryana Staff Selection Commission on the basis of his merit and he had opted for his posting in District Sirsa, where he is residing with his old mother, wife and two small kids.

For the relief claimed in the instant petition, the petitioner has already made a representation dated 30.10.2006 (Annexure P5) to the respondent No.2.

Without going into the merits of the case, we deem it just and appropriate to direct the respondent No.2 to take cognizance of the representation sent by the petitioner and decide the same expeditiously preferably within a period of one month from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed.

Petition stands disposed of in the above terms.
