The prayer made by the petitioner in the instant petition under Article 226 of the Constitution is to issue a writ of Certiorari quashing the order dated 22.3.2006 (Annexure P1-A) to the extent the petitioner has been denied the arrears of pay on his promotion as Arrival Recorder w.e.f. 2.9.1986 to 14.6.2002 and also to issue a writ in the nature of Mandamus to grant arrears on account of his retrospective promotion as such. The petitioner further prays to issue a writ of Mandamus directing the respondents to place the petitioner at Sr.No.256-A in the seniority list of Arrival Recorders instead of 789 and also to grant the C.W.P.No.18710 of 2006 2
benefit of first ACP of Rs.4000-6000 w.e.f. 1.10.1996 with all consequential benefits and refix the pay of the petitioner accordingly and grant arrears along with interest.
For the relief claimed in the instant petition, the petitioner has already sent a legal notice dated 5.6.2006 (Annexure P6) to the respondents.
Without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the legal notice, dated 5.6.2006 (Annexure P6) sent by the petitioner and decide the same within a period of three months from the date of receipt of a certified copy of this order. It shall be appreciated if a speaking order is passed.
Petition stands disposed of in the above terms.
