This revision petition has been filed against orders dated 27.9.2004 and 3.1.2006. It is apparent from records that vide order dated 27.9.2004, evidence of the petitioner-plaintiff was closed by order. He never challenged that order, as such, that order has become final.
Thereafter, he moved one application with a prayer that he be allowed to lead additional evidence. That application was dismissed on 3.1.2006.
Records reveal that by way of additional evidence, petitioner intended to lead that very evidence, which, he could have led at the time, when his evidence was closed. In view of that fact, the Court below was justified in dismissing his application for leading additional evidence. So far as order dated 27.9.2004 is concerned, the same was never challenged by the petitioner within reasonable time and at this belated stage, no interference can be made in the same.
