In view of averments made in this application, which is supported by an affidavit, it is allowed and 37 days delay in filing the appeal stands condoned.
RSA No.3816 of 2005
Respondents filed a suit for recovery of Rs.2,15,760/-, on the basis of a Pronote and Receipt. Suit was decreed. Appellant failed in appeal. Both the Courts below have found that the Pronote and Receipt Ex.P1 and P2 dated 28.5.2002 stood proved on record. It was case of the appellant, that above said documents, were result of forgery committed upon him and he has never signed those documents. To prove said fact, he has not brought any evidence. No case is made out for interference in pure findings of fact as counsel has failed to raise any substantial question of law at the time of arguments.
