By filing this writ petition, the petitioner has laid challenge to the reference dated 11.11.1991 (Annexure P/6) and also the award dated 13.1.1997 (Annexure P/8). It has further been prayed that respondent No.6 be restrained from effecting recovery of an amount of Rs.1,54,548/-.
At the time of arguments, a consensus has arrived at between the parties. Counsel for respondent No.4 made a fair statement that if the petitioner is ready to pay the amount, referred to above, respondent No.4 shall not ask for payment of interest. Counsel for the petitioner has accepted the offer made. In view of the agreed stand taken by the parties, this writ petition is disposed of and the petitioner is directed to pay the amount, referred to above, in four equated monthly installments. The first installment shall be paid in the month of January, 2007. If the payment is made, as referred to above, the respondent shall have no right to join service and also to claim any further relief. It is further made clear that if the petitioner fails to make the payment, then this writ petition shall be deemed to have been dismissed.
Copy of the order be given dasti on payment of usual charges.
