Learned counsel for the petitioner submitted that this writ petition needs detailed hearingn on merit. Prima facie, we find substance in this submission. Hence, admit this Civil Writ Petition.

Shri Anupam Gupta, learned counsel appearing for the then Deputy Commissioner, Ropar, Smt.Seema Jain, submitted at length and informed the Court that his client is present in the Court to assist, even though there was no such direction of the Court. On being asked, she stated that her duties as District Magistrate/ D.C. was primarily connected with law and order problems, and also with judicial works in respect of election matters as she had to perform the duties of Presiding Officer of Election Tribunal. She fairly conceded that there may be some correspondence of formal nature for information etc. addressed to her but the State has till date has not shown any such file to her in terms of the earlier orders of this Court.

Learned counsel for the State stated that the officers prima- facie responsible for this controversy are facing department inquiries and the then Additional Deputy Commissioner has been punished with stoppage of two increments. Learned counsel also submitted that inquiry is likely to be completed shortly, and an affidavit on behalf of the State, thereafter, shall be filed for the perusal of the Court.

Accordingly, notice in respect of Smt.Seema Jain, the then Deputy Commissioner, Ropar is discharged.

List the matter on priority basis.
