The petitioner has sought transfer of the petition filed by the respondent under Section 13 of the Hindu Marriage Act, 1955 and pending in the Court of Shri Deepak Gupta, Additional District Judge, Sonepat, to the Court of competent jurisdiction at Rohtak.
It has been pointed out that marriage between the parties was solemnized on 3.7.2002 at Rohtak. It is the case of the petitioner that she was maltreated at her matrimonial home and was given severe beatings by her husband and her in-laws on various occasions. The present petition for dissolution of marriage has been filed by the respondent as a counter blast to the legal recourse adopted by the petitioner under Section 97 of the Cr.P.C. and therefore, the petitioner has sought transfer of the petition pending at Sonepat to the Court of competent jurisdiction at Rohtak.
After hearing learned counsel for the parties and without going into the merits of the allegations levelled in the petition, I deem it appropriate to transfer the petition under Section 13 of the Hindu Marriage Act, 1955, titled as Virender Singh versus Smt.Santosh, from C.M. No.20352-CII of 2006. {2}
the Court of Sh.Deepak Gupta, learned Additional District Judge, Sonepat to the Court of learned District Judge, Rohtak. It shall be open to the learned District Judge, Rohtak to entrust the said petition to the court of competent jurisdiction.
Parties through their counsel are directed to appear before the Court of learned District judge, Rohtak on 22.12.2006, for further proceedings.
The application stands disposed of accordingly.
