The petitioner has sought transfer of the petition under Section 13 of the Hindu Marriage Act, 1955, filed by the respondent and pending in the Court of Sh.G.K.Rai, Additional District Judge, Hoshiarpur, to the Court of competent jurisdiction at Chandigarh.
It has been pointed out that marriage between the parties was solemnized on 24.10.1971. The parties have grown up children and even grand-children. The petitioner is residing at Chandigarh in a house purchased by the respondent, whereas respondent is residing at Hoshiarpur.
Having heard learned counsel for the parties and also having inter action with the parties, I deem it appropriate to transfer the petition under Section 13 of the Hindu Marriage Act, 1955, titled as Bhagwant Singh versus Manjit Kaur, pending in the Court of Sh.G.K.Rai, Additional District Judge, Hoshiarpur, to the Court of learned District Judge, C.M. No.20500-CII of 2006 {2}
Chandigarh. It shall be open to the learned District Judge, Chandigarh to entrust the said petition to a Court of competent jurisdiction.
Parties through their counsel are directed to appear before the Court of learned District Judge, Chandigarh on 22.12.2006 for further proceedings.
The application stands disposed of accordingly.
