In view of reasons given in this application, it is allowed and 43 days delay in re-filing the appeal stands condoned.

RSA No.859 of 2006

Appellant-plaintiff, by alleging himself as owner of the property, in dispute, filed a suit for possession, which was dismissed. He also failed in appeal. Both the Courts below, by taking note of numerous documents, executed by him in favour of the opposite party, came to a conclusion that he had sold the property, in dispute, in the year 1989. At the time of arguments, nothing has been shown to the contrary. No substantial question of law has been raised.

Dismissed.
