The prayer made in the writ petition is for directing the respondents to consider the date of appointment of the petitioner as 20.12.1993 when his juniors joined and to grant him all consequential benefits of notional fixation of pay and grant of first ACP scale and to release the arrears of pay after refixation alongwith interest at the rate of C.W.P. No. 18646 of 2006 [2]

12% and also to fix the seniority strictly as per his merit in the selection list irrespective of the date of joining.

For the aforementioned relief claimed in the present writ petition, the petitioner has already got served a legal notice dated 29.9.2006 (P-3), upon the respondents.

Without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the legal notice sent by the petitioner and decide the same expeditiously preferably within a period of two months from the date a certified copy of this order is presented to him. If the claim of the petitioner is found to be meritorious and decided in his favour then the benefit accruing to the petitioner shall be given within a further period of two months thereafter. It shall be appreciated if a speaking order is passed.

Petition stands disposed of in the above terms.
