Petitioner Ashwani Sehajpal apprehending his arrest in a non- bailable offence in case FIR No.149 dated 23.7.2002 registered under Sections 406/420 IPC at Police Station Division, Nawanshahr, has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.
I have heard the counsel for the parties.
It has been informed by the State counsel that in terms of the interim order dated October 12, 2006, the petitioner has not joined the investigation. Counsel for the respondent-State on instructions from SI Hans Raj informs that the petitioner is a proclaimed offender in this case and four other cases are also pending against him in which he has not been appearing and PO proceedings have been initiated against him. These facts could not be controverted by the counsel for the petitioner.
In view of the aforesaid facts, I do not find any ground to confirm the interim order dated October 12, 2006 passed by this Court.
