Petitioner Jal Kaur @ Hardeep Kaur has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.94 dated 12.8.2006 registered under Sections 302/324/354/323 IPC at Police Station Raman, District Bathinda.

I have heard the counsel for the parties.

As per the prosecution version, Makhan Singh gave a Kahi blow on the head of the deceased upon which he immediately fell down.

Thereafter Lakha Singh, co-accused, gave a barchha blow on the complainant which hit him on his left eye. He also fell down on the ground.

It has been further alleged that all the three persons, namely, Makhan Singh, Lakha Singh and petitioner Jal Kaur @ Hardeep Kaur gave injuries to his son Balkaran Singh. Undisputedly, petitioner Jal Kaur @ Hardeep Kaur has not caused any injury to the deceased. She is alleged to have been given simple injury to the son of the complainant. Counsel contends that as far as petitioner Jal Kaur @ Hardeep Kaur is concerned, she has been falsely implicated, though she was not present at the time of the alleged occurrence.

The petitioner is in custody since 12.8.2006. No prosecution witness has been examined so far. The trial is not going to conclude soon.

Keeping in view the aforesaid facts, I deem it appropriate to grant regular bail to the petitioner, and she is accordingly ordered to be released on bail to the satisfaction of the trial Court.
