This petition filed under Article 226 of the Constitution prays for issuance of a writ in the nature of certiorari quashing order dated 7.2.2004 (P-1) denying disability pension to the petitioner. A further prayer has been made to direct the respondents to release disability pension along with interest @ 12% per annum for inordinate delay w.e.f. 30.6.2003 i.e. the date of discharge of the petitioner. It is appropriate to mention here that aggrieved against the aforementioned order the petitioner has preferred an appeal dated 7.6.2004 (P-2), which was forwarded by the Record Officer, OIC C.W.P. No. 19422 of 2006

Records, to the office of the PCDA (P), Allahabad, vide letter dated 12.6.2004 (P-3) and the same is stated to be pending consideration of the respondents. The petitioner through his counsel also sent a legal notice, dated 21.5.2005 (P-4).

In view of above, without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the aforementioned appeal (P-2) and legal notice (P-4) sent by the petitioner and decide the same expeditiously preferably within a period of two months from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed.

Petition stands disposed of in the above terms.
