The present revision petition has been filed against the orders passed by the learned Courts below vide which the application moved by the petitioner under Order 39 Rules 1 & 2 C.P.C. seeking injunction against the respondents from recovering the compensation deposited by the State Government on account of acquisition of land has been declined.
The learned Courts below in view of the prima facie material have come to the conclusion that it is the respondents who are entitled to receive the compensation. The rights of the petitioner has been protected by ordering that the respondents herein would be entitled to receive the amount of compensation by furnishing adequate indemnity/surety bonds in the concerned Court by undertaking therein to indemnify the better claimant if any found in future. The learned counsel appearing for the respondents has made a statement in this Court that in case the petitioner finally succeeds in C.R.No. 6617 of 2006 
the suit then in that event the amount of compensation received by them would be paid to the petitioner along with interest @ 6% per annum to be calculated from the date of receipt of amount till payment to the petitioner herein.
In view of this, the learned counsel for the petitioner does not press this petition.
Dismissed being not pressed.
