The prayer made by the petitioner in the instant petition is for quashing impugned transfer order dated 21.08.2006 (Annexure P2) passed by respondent No.2 being illegal, arbitrary and malafide being transferred against within 22 days and against the transfer policy of spouse/couple case as wife of the petitioner is working as Lecturer in Economics at Mohindergarh and only to adjust respondent No.4 at Mohindergarh. A further prayer has been made directing the respondents to transfer the petitioner at any place at Mohindergarh where his wife is working as Lecturer in Economics and have minor school going child and old parents and there is not a single student of Maths in Classes 10+1 and 10+2 at Government Senior Secondary School, Maghogarh.

For the relief claimed in the instant petition, the petitioner has C.W.P.No.19873 of 2006 2

already served Legal Notice dated 6.11.2006 (Annexure P8) to the respondent No.2.

Without going into the merits of the case, we deem it just and appropriate to direct the respondent No.2 to take cognizance of the Legal Notice dated 6.11.2006 (Annexure P8) sent by the petitioner and decide the same expeditiously preferably within a period of two months, from the date a certified copy of this order is presented to respondent No.2. It shall be appreciated if a speaking order is passed.

Petition stands disposed of in the above terms.
