Petitioner Avtar Singh @ Akhtar @ Billa apprehending his arrest in a non-bailable offence in case FIR No.82 dated 28.5.2002 registered under Sections 307/392/332/353/186/34 IPC at Police Station Adampur, Jalandhar, has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.
I have heard the counsel for the parties and gone through the contents of the FIR.
The petitioner was on regular bail in the aforesaid case. On 20.4.2006, his bail bonds were cancelled and he was summoned through non bailable warrants because he did not appear before the trial court and his application for exemption from personal appearance was dismissed.
After hearing the counsel for the parties, on September 22, 2006, the petitioner was permitted to appear before the trial Court and furnish his fresh bail bonds. Counsel for the petitioner contends that in terms of the order dated November 21, 2006, the petitioner had appeared before the trial court and furnished his fresh bail bonds with heavy surety and an undertaking that in future he will regularly appear and will not seek any exemption from personal appearance. Counsel for the respondent-State on instructions from HC Balbir Singh does not dispute this fact.
In view of the aforesaid, the interim order dated September 22, 2006 is made absolute.
