The petitioners apprehending their arrest in a non-bailable offence in case FIR No.56 dated 13.4.2006 registered under Sections 420/406 IPC at Police Station Sultanwind, District Amritsar, have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.
I have heard the counsel for the parties and gone through the contents of the FIR.
Counsel for the petitioners contends that in the aforesaid case, the main accused is Gurpartap Singh alias Gabi and he has already been released on regular bail. He contends that the petitioners are 70 years and 45 years old ladies and they have been implicated in this case because they are mother and sister of the aforesaid main accused. Counsel further contends that in terms of the interim order dated September 12, 2006, the petitioners have joined the investigation. Counsel for the respondent-State on instructions from HC Manjit Singh does not dispute this fact and further states that the petitioners are no more required for further investigation.
In view of the above, the interim order dated September 12, 2006 is made absolute on the same terms and conditions.
Disposed of accordingly.
