The petitioner has sought transfer of the petition filed by the respondent under Section 13 of the Hindu Marriage Act, 1955, pending in the Court of Shri Bhupinder Singh, Additional District Judge (Fast Track Court), Patiala, to the Court of competent jurisdiction at Ambala.

It is pointed out that the marriage between the parties was solemnized on 09.04.2005 at Ambala and a female child was born out of the wedlock on 21.04.2006. It is also pointed out that the petitioner had been thrown out of the matrimonial home after 6 months of the marriage and that the petitioner has no source of income On the other hand, it is pointed out that the respondent is a practising Lawyer at Patiala. Therefore, the petitioner has sought transfer of the petition on the ground that it is not possible for her to defend the proceedings at Patiala on account of resources and the fact that she has to C.M. maintain a small female child.

Keeping in view the averments made in the petition, I deem it appropriate to transfer the petition under Section 13 of the Hindu Marriage Act, 1955, pending in the Court of Shri Bhupinder Singh, Additional District Judge (Fast Track Court), Patiala to the Court of learned District Judge, Ambala. It shall be open to the learned District Judge, Ambala, to entrust the said petition to a Court of competent jurisdiction.

Parties through their counsel are directed to appear before the learned District Judge, Ambala on 19.01.2007.

The petition stands disposed of accordingly.
