This is petition for emergency parole.

The petitioner is stated to be confined in District Jail, Rohtak.

According to the petitioner, he has to appear in examination of diploma in HIV and family education. The request for parole is u/s 3(1)(d) of the Haryana Good Conduct Prisoners Release Act, 1988 from 15.12.2006 to 21.12.2006.

Reply on behalf of the State has been filed to the effect that the Regional Director, Regional Centre, Karnal had intimated vide his letter No.RCK/Exam/2006 dated 8.12.2006 that as per IGNOU Rules, a learner is required to timely submit the examination form in order to appear in the CRL.M.No.74424-M of 2006 #2#

examination of a particular course. It was found that as per the list of examinees received from SRE Division IGNOU, New Delhi, the name of Sh. Yatender Pal was not mentioned in the list.

Further according to the reply, if the petitioner is to appear in the examination then as para 536(b) of Punjab Jail Manual, the Superintendent, District Jail is empowered and shall allow the convict or under-trial prisoner to visit the examination centre under police escort.

Let petitioner satisfy the Superintendent jail that he is appearing in the examination and then Superintendent jail will take action in accordance with law as per para 536(b) of the Punjab Jail Manual.

With this observation, petition stands disposed of.

Copy of this order shall be given dasti under the signatures of the Reader of the Court.
