The Petitioners, apprehending their arrest in a non-bailable offence in case FIR No. 150 dated 1.8.2006 under Sections 452/506/427/148/149 IPC registered at Police Station Shimlapuri, Ludhiana, has filed this petition under Section 438 Cr.P.C. for anticipatory bail.
I have heard counsel for the parties and gone through the contents of the FIR.
Counsel for the petitioners contends that totally on false version, all the petitioners have been implicated on the complaint filed by the maternal uncle (mother's sister's husband) of Smt. Sukhjit Kaur, who was married to Ajit Singh, son of petitioner No.1. Counsel further contends that a petition under Section 9 of the Hindu Marriage Act filed by said Ajit Singh is already pending before the trial Court.
Counsel for the petitioners contends that in view of the order dated 18.8.2006, the petitioners have joined the investigation. Counsel for the respondent-State on instructions from ASI Girdhari Lal does not dispute this fact and further states that during the investigation, petitioner No.1 was found innocent and they are no more required for custodial interrogation.
In view of the above, the interim bail, granted vide order dated 18.8.2006 is made absolute subject to the same terms and conditions.
Disposed of accordingly.
