Application is allowed. Statement of prosecutrix is taken on record.
This is petition for regular bail. Case is for the offence under Sections 363/366/376 IPC.
Dhiraj Pal Kaur is the complainant prosecutrix in this case. Her statement was recorded by the trial Court as PW4, which has been placed on record. From this statement, it would appear that it may a case of gang rape Crl.M.No.59006-M-06 #2#
and that the rape was committed by Dharminder Singh, Satnam Singh and Sukhwinder Singh whereas present petitioner Harjit Singh is stated to have been guarding the room where other accused were committing rape.
Present petitioner is stated to be in custody since 1.8.2005.
Completion of trial is likely to take time. Since there is application under Section 319 Cr.P.C, stated to be pending for proceedings against some other persons not challaned by the police and taking into account the fact that the petitioner did not commit any rape, I find it a fit case to grant bail.
It is directed that the petitioner shall be released on bail by the trial Court to its satisfaction.
