HON'BLE MR. JUSTICE H.S. BHALLA

PRESENT: Shri Vikas Kumar, Advocate for the petitioner.

The petitioner has approached this Court for issuance of a writ in the nature of Mandamus for directing the respondents No.2 and 3 to renew the arms licence of the petitioner for which the petitioner had applied through a renewal application dated July 6,2005 (Annexure P.2).

According to the petitioner, in spite of the fact that a period of more than one year has elapsed, no action has been taken by the competent authority.

After hearing the learned counsel for the petitioner and taking into consideration the averments made in the present petition, we find that a legal notice (Annexure P.5) dated August 5, 2006 has been served by the petitioner which remains unresponded so far.

In this view of the matter, without going into the merits of the claim made by the petitioner, we dispose of the present petition with a direction to the District Magistrate, Mohali, Punjab, respondent No.3 to take a final decision on the aforesaid legal notice (Annexure P.5) within a period of four months from the date a certified copy of this order is received, by passing a detailed and speaking order and take such further appropriate action, as may be required, in accordance with law.

A copy of the order be given dasti on payment of usual charges.
