Chand Singh & Ors v. State of Punjab & Ors - CWP-18419-2006 RD-P&H 12335 (11 December 2006)
CWP NO.18419 of 2006
DATE OF DECISION: December 5, 2006
Chand Singh and others
State of Punjab and others
CORAM:- HON'BLE MR. JUSTICE VINEY MITTAL
HON'BLE MR. JUSTICE H.S. BHALLA
PRESENT: Shri R.K.Battas, Advocate for the petitioners.
The petitioners have approached this Court making a grievance against the proceedings initiated by the State Government for converting some land into commercial and residential sites. It has been alleged by the petitioners that the aforesaid proposal includes their land as well and has been mooted only with a view to benefit M/s.Ansal Mittal Township Pvt. Ltd., respondent No.5. The petitioners have also challenged the communication dated September 28, 2006 (Annexure P.6) by the Punjab Urban Planning and Development Authority to Deputy Commissioner, Bathinda.
After hearing the learned counsel for the petitioners and taking into consideration the averments made by the petitioners in the present petition, we find that the grievance made by the petitioners is wholly pre-mature. It is not in dispute that as of today, the land of the petitioners has not been acquired and no proceedings whatsoever have
been initiated for the aforesaid acquisition. In these circumstances, we find that the grievance made by the petitioners is wholly without any basis. However, as and when any process for acquisition of the land of the petitioners is initiated, then the petitioners would be at liberty to raise objections against the same and take such further proceedings as are available to them, in accordance with law.
Disposed of with the aforesaid liberty.
