The petitioner has filed this petition under Section 439 Cr.P.C.
for the grant of regular bail in case FIR No. 207 dated 15.8.1980 under Sections 406/409 IPC, registered at Police Station Civil Lines, Patiala.
I have heard counsel for the parties and gone through the contents of the FIR.
The petitioner is in custody since 26.8.2006 in a case to be tried by the Magistrate. The case pertains to the year 1980 and at one stage the petitioner was declared proclaimed offender. Now, supplementary challan has been filed and charge has been framed against the petitioner but no prosecution witness has been examined as yet.
Keeping in view the aforesaid facts and the custody period, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail subject to his furnishing bail bonds and heavy surety to the satisfaction of trial Court.
