The petitioner filed C.W.P.No.6593 of 2005 which was allowed by this Court in terms of the Division Bench judgment in the case of Vinod Kumari and others vs. State of Haryana (C.W.P.No.66 of 2006 decided on 4.4.2006)
It is not disputed that in Vinod Kumari's case , the State of Haryana has filed an SLP and vide order dated 14.8.2006, the Hon'ble Supreme Court has stayed the operation thereof.
Since the petitioner's writ petition was allowed in same terms as in Vinod Kumari's case (supra), I am satisfied that the respondents have not committed any wilful or deliberate breach of the orders passed by this Court as the petitioner's fate is similar to that of the writ petitioner(s) in Vinod Kumari's case. Consequently, this petition is disposed of, however with a direction to the respondents that in case their challenge in Vinod Kumari's case before the Hon'ble Supreme Court fails, the orders passed in the case of the petitioner shall be implemented forthwith and without any delay.
Rule discharged.
